Or any one else that has been helpful with my questions re: upcoming crown court case over the last 5 months (last post here http:// www.the answerb ...Ques tion117 5872.ht ml)
My court trial is listed for this week (commencing 15 Oct). I have to ring every night at 4.30 pm to see if im in court the following day....I rang Friday to see if I was listed for Monday, I wasnt.
I have copies (from my barrister) of all witness statments, transcripts etc.
Now for some reason, the police have turned up at my nieces home this morning to take a statment from her (she initially refused to make one).
Why would the police wait for 5 months to take a statment and then decide, a day before my trial week, to go and get a statment.
She has made a statment that contradicts the polices version of events and is effectivly a defence witness.
I'll be in court one day next week and presumebly her statment wont be prepared in time for defence or prosecution.
There someething very funny about how the police are dealing with all this. If anyone can shed any light it would be appriciated.

As to time , the statement just has to be written down, checked and signed by the person (your niece) who gives it. Then copies will be distributed to the solicitors of both sides. They can email the copies so I think it can be done in time. They may ask for an adjournment though. I do not see that this harms your case , in fact I think it strengthens it.

EDDIE, many thanks for a very quick response.
I have to ring my barristers office tomorrow to see if im in court on Tuesday so Ill have a chance to talk to someone from my legal team then but Im impatient I guess ;-)
I cant see how the police could not know that it wouldnt make it to court as the cps were in touch with other witnesses months ago to tell them that they would have to make themselves available for court this week and as the arresting officers were witnesses and presumebly would have to attend court and give their 'evidence' then surely they would know? To try and get a statment the day before my trial week, when they have had 5 months to do it, seems to me to be unproffesional at least and fishy at best.
Just hope it doesnt get adjourned, Ive had 5 months of hell waiting to get this over with.
