Hi there,

at the start of June I started working for a Canadian web hosting company. I worked there for two months, and never received payment. I was 'let go' at the start of this month for the reason given as restructuring, it was all very civil and I understood.

They told me that they'd give me my two months outstanding wages ($1,600) the next week (week beggining 5/8/13). Now, I've been sending emails all this week and have heard nothing from the CEO or VP of the company.

I was wondering what my rights were regarding getting this money if I have to attempt to get it forcefully. My sole concern being that I'm not 100% if they had put me on their 'books' as an employee or not(they've suggested that they have) and if they haven't all I have for proof of employment would be an NDA I signed to work for them, a ton of chat logs and emails and I'm friends with a fellow employee/contractor for the company.

I'm not sure where I stand since I'm not working for a company based in the UK and I'd appreciate some advice; thanks.

If someone owes you money (irrespective of the part of the world that they're in), but fails to pay it to you, all you can do is to pursue the matter through the courts. Canada has Small Claims Courts but they're administered on a provincial basis, not a national one. Simply googling 'xxxxxx small claims', where xxxxxxx is the name of the province where the company is based, should direct you to the relevant procedure.

However, on a more practical note, I strongly suggest that you abandon sending emails (which easily can be forgotten about, given low priority or simply ignored) and start phoning. It's hard to ignore an irate person on the other end of a phone line!

Hi Chris, I've tried calling and those go ignored and unanswered also, I've not been as nearly as persistent though, as this isn't a bridge I want to burn quite yet.
i would not worry about burning bridges here - would you really want to have any future dealings with these people?
from their conduct i very much doubt you have a hope in hell of any future work with them
