I want to remove a garden wall, is made of breeze blocks. Eventhough it is in my garden - it retains patio chippings for the next door neighgbour. It is fractured the base , not sure how safe it is but want the ugly thing pulled down.
Ask your neighbour to remove his chippings and tell him that you want to remove the wall. Be polite. Ask his opinion of the change. Discuss with him any possible alternatives.
If it is a retaining wall you cannot just remove it.
Unless otherwise stated in the deeds it is usual for the higher land owner to maintain his property and the retaining wall. Unless of course if the ground is level and one party excavates away to become lower then he has to retain.
If it is just chippings being held up then explain to the neighbour that you intend to knock the wall down and can he move the chippings untill the wall is rebuilt.
I think it is reported to have been Winston Churchill who at a luncheon in 1954 said words to the effect of “It is better to jaw, jaw than war, war”; this is particularly true when it comes to dealing with your neighbours.
