hi could someone either find one of buenchico's answers or give me the correct answer of how to properly go through a small claims claim for someone that owes me money?

Although its from a while ago, I read this excellent book, and won my case before it got to court. Thank you Navroza.

well done everyone - you deserve an update as at that very time I was having to learn the 'new ' system

well in my case - I sent the following email -
I wasnt sure that the LBA (letter before action - see BuenChico's answer, er was one)
so this was kinda an email-during-action

Dear Jack

I was making a claim on MCOL – the new small claims court procedure – against you,

and it is made quite clear that we should be making an effort towards a settlement before I send in my £100 court fee and make a claim against you for some £800.



Also the claim statement is limited on the court document to 1000 letters and characters

and states that any longer claim should be sent to you



So here it is –

I await your comments – please use this address for email

and 0161 xxxxxxxxx for phone





" Statement Of Claim Shaw v Tigerbox and Jack Sutcliffe

1. Tigerbox is a limited liability company (co reg 132673) and Jack Sutcliffe has been an employee of it at all relevant times.

2. Tigerbox advertises wooden sheds on the internet and promises delivery within 12 days

3. The defendant contracted with Tigerbox for a shed cost £743.96.to be delivered within 12d as advertised. This was on 30 June 2013 and concluded on the internet.

4. The sum £743.96 was debited from the claimant’s account on 1st Jul 2013 by internet

5. 12th July passed without any news, and the first worry is that this was an internet fraud....... "
[ the statement of claim drones on with all the ins and outs of non delivery and non refund, no reply unreturned calls, stupid emails and so on until er last week.... ]

and so the statement went on and on

and I have to say it did concentrate his mind on the matter

to the extent that the offer of a refund went out at 10 pm on a Saturday night.


and if anyone recognises the name ..... that advertises on AB yup

the conclusion is that before contracting with Tigerbox it is vital for any buyer to googel and read - tigerbox reviews

your hair will curl

and to use a credit card and not a debit card in paying
actually advice which is on the review site

Oh and I ws told that Tigerbox didnt take credit cards now.....
hmmm if it were true can you guess why ? (money back for non performance much easier)

and get suing Bodnobs - dont get angry - get on with the job....

Peter, is it wise to post the real name of a company on this site? I think not!
I wasnt exactly advertising.....

MCOL would be a lot easier if you can do your claim online but if you need any help about other ways of making a claim then just grab my attention somewhere.
