An elderly man almost looked dead in the car and myself and a friend called an ambulance and the 999 operator told us to break the window in case CPR was needed.
The man was breathing but it was concluded he was in a deep sleep.
The insurance company has now sent me the bill for the window.
Am I obliged to pay it..

Years ago I was sent round to see if my 'g/f's' grandmother was ok. I went round alone and I couldn't see anyone in the house but we were concerned. I then saw through a blind her nan sat up looking rather still. I got the same *** on the phone and even the next door neighbour said when he passed me the hammer "you know we're going to get shafted for breaking and entering".. You'd be amazed how quick I got that door open. Once I got in it was rather clear. She was dead and she didn't go happy. The police actually tried to questions me and wanted to have me for criminal damage even when she had passed away. You can imagine my response and her nans facial expression will never leave me until the day I die.
Me - I commend your love of Judges Rules on commenting on current cases [sub judice ] The Loyley case was 1998. Fifteen y is not current. Decided o god years ago.

the doctors found not negligent - Bath Marathon - hey its in a few weeks ! - has better cover nowadays

Quite a famous case at the time for first aiders and others

it's like reading 3 different threads, no one is taking any notice of anyone else and are just blathering on.
PP [waves]Tony Weir was a law lecturer in Southampton who wrote a very good book on Tort.

Now, what was that case were undertakers suffered the misfortune of the coffin falling out of the hearse when it was travelling, and the family mourners sued because of the shock at seeing their deceased relative hurled down the road ? Can't remember the name of it.
People are blathering on because the JaneGray hasn't really inputted since the initial post. Did she bang on the windows, did they rock the car? How did she think this person was dead? He must of been in some serious deep sleep.

Did the police attend? if not why not?

You just smashed his window and just left on your jollies?

The reason this thread has gone to pot is because none of it makes any sense. You know if I think someone is 'dead' or 'unconcious' in a car, the first thing I do is get in. Also how did you break the window?

There just isn't enough information sorry.
An old man in a car looks dead. I'm going to try the doors then I'm going to bang on the windows. I'd try rocking the car but I would try moving it (pushing). I don't understand your logic in this matter but given the circumstances I don't know how you can be found to blame.

I suppose you should of just stood and waited for the emmergency services to come and smash window whilst the person died.

JaneGray: I feel sorry for you, you were trying to help this guy and he has clearly tried to make you stump up the cost for a replacement window.
*wouldn't try moving it.
Bloody hell Dismal, are you for real ??
Sorry, but all this is a tad surreal.
Can we just sort this out once and for all, JaneGray cannot respond because she/he/they are now suspended - they can of course watch and read everyone running around in circles.
As is playing games with someone's user name ferlew.
Bloody hell, I am sorry all this seems so unreal to me.
I didn't realise Jane was suspended. Well I feel unwelcomed at the moment so I'm going before allow this to get to me more than it already has
Behave you !! LOL
You know that is not true.
Something similar happened to us recently. Next door neighbour came home and parked on drive. Two teenage girls who were busy texting noticed he was slumped to one side in the car. Told OH who was cleaning cars. He investigated, came and asked me to phone 999. I did after checking on driver, door was undone, he was either in a deep sleep or unconscious. Couldn't rouse him. Medics arrived, did tests, took him to hospital, in for about four days. He lives on his own, personal hygiene not very good, loAds of bags of rubbish on drive, very worrying really. He's home but not coping very well. Difficult to know what to do.
PP- re your post at 22:44 .
I didn't say there was no pattern.
When I said earlier "It's difficult, P-P. " I was answering the question you'd asked a few minutes earlier rather than the "is there a pattern " question which was posted at the same time as my reply.

Time to leave this thread I think. We are going round in circles and it's a bit surreal. It may be removed but it does throw up some interesting issues about the original question so maybe Ed will leave it.
