I don't think you can get legal aid to challenge the DWP's decision not to allow you ESA.
Have you tried claiming JSA? It might be your best hope to get some money for now. You will have more hoops to jump through, though.
I despair of this government. How are people supposed to live?

Food bank ought to be your priority- go and see your GP or practice nurse- they can put you in touch. Why was your ESA stopped? It's usually the case that if your ESA stops then you can slide over to JSA- do you know why this hasn't happened. Go into your local job centre and ask to claim JSA or if your Dr is giving you sick notes make an appointment with them to discuss your ended or suspended ESA claim. I think if you make a new claim it is likely to be PIP but not entirely sure what's happened to you without more info or to what you might be entitled, but certainly the first step is your health, so see someone who can help refer you to a foodbank.
you need to find out why ESA stopped...if you were on contribution based it stops after a year and you have to fill in form again for income based ESA..that is means tested and awarded on sliding scale ..if you have less tan £6k you will get full rate...you need to ask at job centre today !!
but..a partner or spouses income will also be considered...
you need to speak to your nearest cab office as soon as possible, this happened to a lady near me she had no money for just under a year and had the bailiffs, gas and leccy etc all at her door

http://www.citizensadvice.org.uk/index/getadvice.htm
and get it backdated
murraymints in your dreams the lady near me got i think about 4 weeks as there were laws in place to stop them paying more
murraymints each letter they sent to the lady near me was scanned into my computer including the illegal one they wanted sight of which then mysteriously vanished ( which i said they would destroy to her )

so i saw all that went on
it depends on the reasons for backdating..if he was misinformed or not informed at all when contribution esa ended it can be backdated ...if he simply didn't bother or was ineligible at the time then a 4 week period is the norm...
illegal letter ?
the letters they sent to the lady had to be shown to the solicitor when the solicitor saw this letter she was shocked and said it was illegal

when it was pointed out to the dwp they wanted sight of the original letter and not a copy ( which i wanted her to send in )

after they got the letter it vanished and they said they have no record of this letter ever existing

these were all on my laptop that packed in , i may have all these letters on disc but will only find out when i move and check all my discs
in what way was it illegal ?
did the solicitor not keep a copy if she was so perturbed by it ?
> did the solicitor not keep a copy if she was so perturbed by it ? <

probably but we are going off the subject this person needs help, and needs it now

jkz if you have problems getting to speak with the cab does your local council have a welfare rights office that could help you ?
jkz needs to ask for a crisis loan pending award of further ESA
No crisis loans..? so ask at job centre what has replaced it in area !
Local Assistance Scheme run by the local Council?
this of course all hinges on his status re savings and spouse /situation..
