Hypothetical question,if I work nights,and somebody says to me i want to leave a car across the road for Joe Blogs to pick up in the morning will you look after the keys and give them to him in the morning.I say yes but overnight the car gets damaged or stolen can i be held responsible in any way,do i take responsibility for the car by looking after the keys?
why should you ? If you have house keys and someone comes along and burgles it, would you be held responsible - NO or else the insurance companies would say every time, ah but the householder has the keys and we arent paying that either.
Even if in a mad way, you say you would be - the difficulty is that there is no contract ( no value passing the other way ) -
