I have a tenant I need to evict for non payment of rent. They have not paid rent for 7 months (I know I should have checked earlier

How long is there lease ?

if you are at the end of the lease and it is 'run on' then a s21

if you are in the middle of a lease then you have to use the s8 pathway which is here

The lease ran out and they are now on a periodical (I think that is what it is called.

and select the accelerated path

You MUST use the prescribed form

and you MUST put in the last day of the lease period, and not the day you want the property - basically the 31st of the month
andit HAS to be eight weeks or more from the day you give it to them

I would say that you should deliver it as otherwise they just say they havent had it.
