No idea what species of property it is but whether its assignable or not will depend on the T and C's of the gym.

technically choses in action are tangible and intangible
this would be an intangible one ( well you used the phrase first )

and it depends on the contract for membership
( and I would expect them so specify not )

You are in Unfair contract terms act 1977 territory here and I would expect a judge to say it is NOT unfair ( but that is my opinion )
