If the parties cannot agree amicably, who decides? If one party has their own flat that is not the marital home, does this constitute part of the combined assets?

court will decide if you can't...
ALL your assets are "shared" in the event of a divorce, even if it say his car or her car, they are counted as joint assets.

Even a future pension for the man or the woman is counted as a persons asset.
