The law on 'joint enterprise' means that when a group of people assault someone they are all equally guilty of causing the injuries which result from that assault. (So if one of the other attackers had knifed the victim, resulting in his death, you would be just as guilty of murder as the guy with the knife was).

I'd say so. Barging into a property, with a group, and beating up the owner in front of children, will likely lead to custodial. The fact that you pleaded 'Not guilty', despite the evidence isn't going to help you, you having children of your own isn't a mitigating factor either. Only single mothers tend to get that taken into account. Have you shown any remorse, have you apologised to the victim? Your defence counsel will have to try to convince the judge/jury that the attack wasn't pre-meditated, if it was, and with the other factors taken into account, then a custodial sentence is the likeliest outcome.

I may be reading between the lines here (maybe because ive been in similar positions in the past) but I get the impression that you KNOW that youre going down and are grasping at straws, and your real concern is how to get through a prison sentence?
If I'm wrong then I apologise, if I'm right then ask a different question and you might be surprised at the support you will get on here.
As EDDIE and Buen have pointed out, custody is a very real possibility and needs to be faced, as painful as that is.

Nalit, we know that she has been found guilty at magistrates and has now been 'referred up' to Crown for sentence.
I still have to say I will be very surprised if this is less than a 2 year sentence and not suspended.
If you get 2 years you will serve 1 year with possibly the last 90 days spent at home 'on tag'. So at least 9 months inside !
As a violent offender there is no hope of getting sent to an 'open' prison , not sure there are any open jails for women anyway !

EDDIE,
//As a violent offender there is no hope of getting sent to an 'open' prison//
Not so sure of that. I got an 8 month sentence in 1997 for ABH and got a cat D (open prison. I legged it from there but that's another story :) )
And I know a few others who got a cat D with violent related offences. That was nearly 20 yrs ago tho and things may have changed since then.
