Hi guys just wanted some help really. My friend got into a fight last week which wasn't his fault as he was provoked and stuck up for himself this obviously resulted in him defending himself for self defence purposes, the other person informed the police and he attended the station on Saturday I have not heard from him since and I am beginning to panick his phone was off for a considerable amount of time but is now on and it just rings no one can get a hold of him I presume the police switched it on for him to get a number out for his one phone call and have not bothered to switch it off he would this be a case of abh as no weapons were used? He also has a previous being in a similar sort of situation to which he served 7 months however this was over 4 years ago now he is not a bad a person and has 3 very young children the youngest being twins at one years old, would be have been granted bail? How long can the police keep you in custody for a offence like this as I know you cannot be kept for longer than 24 hours without being charged? Does anyone know what has likely to have happened to him I understand they can appeal for up to 96 hours to gather evidence but would they do that for a charge like this? I don't know how to locate him is there anyway I can Find out if he is in custody?

The level of assault charge depends solely upon the level of injuries sustained by the victim.
e.g:
No injuries (or very minor injuries) = Common Assault
Injuries requiring a few stitches or minor fractures, such as a broken finger = ABH
More serious injuries, such a fractured jaw or skull = GBH
(GBH can then have 'with intent' added to it if there is evidence that the offender intended to cause such serious injuries)
As you've not given us any idea of the level of injuries sustained by the victim, nobody here can know what type of charge your friend might be facing. It might only be ABH but it could be GBH (or even 'GBH with intent')

Once charged,the police have to release an (alleged) offender on bail unless there are specific reasons for not doing so. (e.g. because they consider that he might commit further offences while on bail, for his own safety or simply because of the seriousness of the offence with which he's been charged)).
So there's not really enough for us to go on. However I suspect that he's been charged with a serious offence (such as GBH) and then refused bail. It will then be up to a court to decide whether to overturn that refusal or to remand him in custody.

Hi guys it was not allowing for me to reply to you're messages so I am unaware if you will receive this. If I call 101 will they actually let me know this information?? What exactly do I say? I understand they am refuse to also? He went on Saturday would he still be there? If he's elsewhere would they be able to tell me? Also I'm sorry about not giving you enough to go from as I am not sure in regards to the extent of the persons injuries I know he was punched a few times but no weapons were used I heard the injuries were not that bad so we was hearing. Would you normally get granted bail for an abh offence? As I mentioned he has a previous to which he did 7months inside around 4 years or so ago. Does anyone know what happens to husband personal belongings if he does get sentenced
