we are sorting a very small estate (less than £1000 in the bank) It's going to be insolvent. Is there any difference in ordinary creditors and a private pension that was paid after she died because we didn't tell them untill a week or so after she'd died?

I thought Barmaid might volunteer

I would take it as a payment wrongly made
which is kinda true
and not tell the provider you are putting him on the list of creditors as he might go after the exec/administrator for taking it when he shouldnt

otherwise funeral expenses come first
and at £1000 that will be quickly expended

you could put it as a testamentary charge

I have left aside whether or not you can operate the bank account or whether it is now completely frozen
I closed a frenz account a day after he died
( on the grounds above)

louds squawks from the bank mgr - whose first closure case it was - and I dont feel so guilty about throwing my weight around

death certificate 5 months and 30 d later

( she rang up the funeral director who said yup there is a guy with a label on his toe ....)
Think you need to be careful about the pension paid after death, could be considered fraud, just fess up and they can give the percentage that should have been paid, not worth getting into bother about.

you are keeping good accounts

with my friend - £2.14 in the account and the bank refused to open an exec's account - so we agreed that John smith could pay further sums into JOhn smiths account - cheque payable to George Brown decd

yeah dont ask me .....

and I kept accurate accounts goot I can tell you

there will be other sums to the estate - TVL rebate - and if she paid DD then the utilities will rebate - and the govt pays a months pension and there was a bit in from DLA
( oh you could use that as an reason when you repay)
so total further assets post mortem to pay in were around a grand

funeral £4000 and debts of £9000

beware marauding relatives who say - we heard there was £1000 can we have it - it after all ours.....
and I said - funeral Do you want to contribute towards his funeral
( they said no)

thatnks for your answers, but im no further forward really. We want to just pay the overpayment back (about 100 pounds) but wondered if the other creditors (who will only get a percentage) will mind. Funeral is done and dusted (1 year ago)
re read the thread

if you ask too many people - the pension people will say yes deffo
and the rels will say no! no!

i still dont think the overpaid pension was ever the dead persons
( personal opinion of course read the top of the page)
