I'm doing my law homework and one of the scenarios is -
Albert Hardup has been arrested for the murder of the local bank manager as he was trying to steal money from the safe. He was charged at 11pm on a Sunday Evening and has been kept in custody overnight and is due to appear at the local Magistrates Court the following morning. Albert intends to plead not guilty to the charge and is determined to prove his innocence.
- I know that due to the murder of the bank manager the case is indictable, which would only be dealt with by the crown court, but magistrates only deal with triable either way or summary right? So what would the outcome of this case be?
