I know that this has been discussed before but cant remember a definitive answer.
Where would a fully transgender prisoner serve his/her sentence? In a prison of their birth sex or their new sex?
Is anything stipulated in law about this.
Thanks.

In a prison for their birth gender ,unless they have a official certificate of gender reassignment ( not sure of the exact name) that proves they are now medically the opposite sex.

Thank you EDDIE. Ive mentioned before that I was in HMP Liverpool with someone who was half way through a sex change procedure (male to female) when he got sent down. Just curious as to how it works after having the full reassignment.
“That is why prisons exercise local discretion on the placement of those who live, or propose to live, in the gender other than the one assigned at birth. In such cases, senior prison management will review the individual circumstances, in consultation with medical and other experts.
But as you probably know nalit , anyone who has a 'gender disorder' of any type ,certificate or not, is regarded as 'Bent' and will have a terrible time in any prison male or female. They are only marginally above child rapists / or child sex abusers in the prison rankings.
if she has the reassignment certificate from the Gender Recognition Panel, then into a female prison. For FtM, I am not sure but would think it works the other way.
The MoJ says it does not know how many transgender prisoners are being held in its jails. Announcing an expanded review of procedures, the justice minister Caroline Dinenage said: “Transgender adult prisoners are normally placed according to their legally recognised gender. However, we recognise that these situations are often complex and sensitive.

Cheers for replies all.
EDDIE, the guy (who was transforming into a woman) that I was in Liverpool with actually got more flack from the screws than the other cons. The reception screws were ringing their mates on the wings to come down and have a laugh at the freak in high heels, a wig and with a pair of breasts. It was the medical staff who put him in a single cell on the hospital wing, the screws were going allocate him a cell on the regular wings where no doubt he would have suffered but on the hospital wing the other cons were sympathetic to him.

//The MoJ says it does not know how many transgender prisoners are being held in its jails//
That sounds like incompetence, why does it not know?
^ very far from 100% of trans people will even admit they are 'trans' especially if prison is involved. There was a transitioning male 'pre-op' working in the kitchen of the prison I worked in. Many of the cons would refuse to eat the food if they suspected the 'poof' had touched it. That is how hated they are.
Eddie those words are unacceptable and putting them in quotes does not make them acceptable!
Question Author
I think EDDIE was just quoting how other prisoners would have referred to him Islay. Not how EDDIE would have referred to him.
IMO there is no need to use them at all it brought nothing his 'stories'
Question Author
EDDIE I have no doubt that if he was placed on a regular wing he would have been severly abused, but most of the cons on the hospital wing had some serious mental disorders and were by and large sympathetic to others who were seen as different.
Which words would you have used instead, Islay? I don't see anything wrong with Eddie's.
Islay, I am just quoting what was said. The word has passed AB censors without modification. So why are you worried ,are you the new self appointed AB censor?
Poof was easily the mildest of the words used to describe him.
Cloverjo he or she could have been used instead.

// he or she could have been used instead//
But that wouldn't have been an accurate description of how transgenders are spoken to or treated in jail.
Well as your question did not ask for a true representation of how transgender is treated in prison there was no need to write it at all was there!
Question Author
Well, I happen to think that EDDIE was making a valid point about how transgenders get treated in prison. Don't see the problem myself.
I can see why Islay was upset although I think in context Eddie was making a reasonable point. Better to let it slide. Life can be rough enough for transpeople as it is.
