I'm no legal expert, but I do find your question a little unclear. Who's grave did they dig up ? What were they obliged to do ? What was the connection between your mother's death and your father's plot ?

I would imagine the family of the wrongly disturbed grave had the right to sue.. you could possibly ask for emotional distress compo..speak to a solicitor...
