One Has let’s say an i before an e in our middle name and vice versa
If the US authorities already have your own passport details on file and you (in the guise of your sister) attempt to obtain a VISA and then try to gain entry or your sister applies for a VISA and you use the documents to gain entry - I should think you run, at least, the risk of being put back on the next flight home and worse - possibly arrest/prosecution and all that entails.

Hypothetical? I would not want to risk it especially given your telling of the recent experiences:-

My brothers not on the nf list hence the question. It’s my only child, we went through hell and high water to conceive her, financially, emotionally and physically. I have to be there.
and being in prison will help? don't forget the biometric scanning.
There is also the potential to implicate your brother in your proposed deception and both of you might encounter difficulties with future travel to the US. You may also have problems in renewing your passports for travel elsewhere. I think Bazile suggested in your other post that you might want to contact your MP and ask that it be taken up with the Foreign Office. Perhaps this might be the most sensible course of action?
Don't feed the trolls
As an identical twin myself, I wouldn't dream of compromising my brother by such a deception.
They take your fingerprints on entry to the States.
///I have an identical twin with the same name....///

That must have been confusing for friends and family....
I think someone's pulling our legs...

It's the kind of thing that happens all the time.
I remember watching a documentary series about one guy who did it constantly, Jason Bourne I think his name was.
Never a bit of bother from the powers that be.
Tommy Robinson, for example, didn't get away with using someone else's passport
there is/was a vogue to naming children with almost identical names
as in the lovable goofy gap toothed child sit com with Tia and Zia Landry

NHS numbers were one digit different and this could lead to blood transfusion confusion ( no no dont say - impossible if they were identical)

so Antifa cd have a twin Antifo

"supports the discriminability of some of the identical twin biometric traits, such as fingerprints, iris and palmprints." but iris prints arent immutable - ( iritis, injury etc)
AND.....
my cousin is identical and yup I take his twins passport on hols with us just in case he loses his ..... havent had the embarassment of 'excuse me - there are two of you and three passports ... yet'
