If a person has got 12 points on his licence and of course licence taken - how does that person have to wait until he/she is allowed to drive and also do they have to sit a driving test all over again. thanks

The licence is not always withdrawn once the person reaches 12 points.
They can reapply for their licence before their disqualification period ends I do not think they have to take a test again.
If your license is taken away from you then there will be a disqualification period and you will need to re-apply like a new driver.
The minimum disqualification period following accumulating twelve points in three years is six months. Magistrates may impose greater (though rarely do unless the driver has been banned in the previous three years when the minimum is twelve months). They may reduce the six months period potentially to zero is the driver argues that "exceptional hardship" will be suffered by him or others if he is banned. Anecdotal figures suggest around 25% of such arguments are successful.

Normally no test need be taken at the end of the ban and the driver can apply for a new full licence covering the same vehicle groups.
By law, you cannot apply for a driving licence before your disqualification period has ended.
Disqualification for drink or drug driving

You can reapply for your licence before your disqualification period ends.

DVLA will send you a D27 renewal form:
•56 days before your disqualification ends
•90 days before your disqualification ends if you’re a high risk offender

Fill in the form and send it to DVLA with the fee. You’ll be told if you need to send a new passport-style photo in the D27 renewal form.
New drivers

You must apply for a new provisional licence and retake both parts of your driving test if your licence is cancelled within 2 years of passing them.

If your licence is cancelled you can apply for a new one at any time. Order form D1 or get one from the Post Office. Send it with the fee to the address on the form.

Just on a point of pedantry, the licence is not "taken away". The driver is disqualified from driving. To understand the difference, consider a driver who never held a licence. He does not possess one to have taken away but he is still disqualified.

Spath, It was me who mistakenly put the procedure for NI. Not RR.
Answer: because you are confused:

Applying for a new licence has no relevance to the need to take a test. The only circumstances where a test needs to be taken are:

- if a driver accumulates six points or more in the two years since passing his first driving test

- when a court orders that a driver is disqualified from driving until he passes a test (meaning he can driver as a provisional licence holder only following the end of his ban)

- he is disqualified for an offence that involves a mandatory re-test being taken (e.g. dangerous driving).

In the first two circumstances a normal re-test is required, in the last an extended re-test is required.
