If I bought an Avocado from a store which outwardly looked perfect but on cutting was rotten and inedible would the shop in law be responsible for replacing it or would they argue that it was sold in good faith and a refund or replacement wouldn't be forthcoming?

The shop would be responsible for its replacement. It is not fit for purpose (i.e. eating).
Dont think they'll argue or make you feel embarrased. Theyd apologize and change it immediateley. No need to take them to small claims court or appoint an Avacado Advocate

Thanks folks just wondered.
Sqad... this is dangerously close to being a "what are you having for lunch" thread ;o)

The Builder lol.....God forbid.
well not avocado obvs
Strangely I would have trouble arguing that a rotten avocado is not "fit for purpose" (i.e. eating). I find even the best ones not fit for eating and would go further to make them a prohibited substance :-)

Love the "avocado advocate", bobbin!
NJ, so you´ve never tried mashed avocado on toast with marmite and a squeeze of lemon? its so delish imho.
Avocado, lemon juice, olive oil and salt and pepper- on toast, with poached egg :-)
But sqad, the responsibility is with the shop that sold it to you.
Definitely not. The toast and Marmite I can do but to contaminate it with the Devil's Food which is avocado is a criminal offence. :-)
NJ, if you voluntarily eat marmite. No-one can help you :-)
Any mainstream supermarket would refund you. My favourite breakfast is mashed avocado on seeded toast, with smoked salmon, a poached egg, coriander and Barbados hot sauce. Twelve quid at Bills in Covent Garden but cheap at home.
Doubt very much that a rotten avocado would stand up in court !
I didn't have one tonight - maybe tomorrow as I am on a non-meat diet before having a b-p test on Thursday....

tagliatelle pasta with pre-steamed green veg, (green beans, mangetout, peas) and some fresh mush - then a sauce made of Normandy cream/marscapone/lemon rind, juice/ pecorino cheese (grated) and chopped dill, mounted with a little butter, and then cooked on top of the pasta cooking pot as if it was a bain-marie (and whipped at the same time).

Then assemble the veg with the drained pasta, add the sauce and stir before final seasoning. Dead easy!

Avocado could be added.....

If this doesn't turn on your gastric juices, Sqad, may be the pic of the recipe chef will, other juices though.....

The shop may refuse to refund or replace (because some shop keepers are stupid and also some shop keepers have been a constant victim to scam claims - there are many of both). That leaves you with taking action. You can leave a negative (but fair) review on a rating website. And you can withdraw your trade. You could stand outside the shop with a placard stating "Supervados sold me a rotten avocado on 22/2/2021 and they wouldnt replace it. Mrs Sqad was so upset at the lack of guacomole she refused to wear her satin blouse for a week. Avoid this outlet."

Failing that, you are not realistically going to sue for a rotten avocado. (Unless you really are very very silly and have lots of time and money on your hands - that is not to say that all of those factors are present in your case Sqad). So you just dont buy from that store again.
I’ve had avocados which are inedible for various reasons, just threw them in the bin and moved on.
Avocados look the same on the outside whether they’re ripe, under ripe or pretty inedible.
Why would you bother taking it back to the shop?
Not worth the bother in my opinion.
If you know the store folk, they will honour an exchange - one avocado for retaining your business...???
I wouldn’t stop buying from a particular shop that I liked just because I bought one dodgy avocado from them.
Cutting off your nose to spite your face.
Life's too short to worry about one avacado.

Mrs sqad had no intention of returning it, my post was to educate myself on a point of Law.
But thank you all.
