Neighbours Garden Issue

Our neighbour has dug down in preparation to building his own fence, which will back onto ours, but not till next year! In the meantime, the weather is causing our garden to be eroded, due to the 18" trench he's left, we have plants in place, which are in danger of falling into the trench he's left. Any ideas please? He has been asked when the fence will be in situ, 'next year' is the answer.

Point out to him the danger of your plants being damaged because of his trench, and ask him if he will bear the cost of replacements.
