parking just near by ( not in front of)someones driveway is it legal? and near we can park.

As long as you are not blocking an entrance and there are not any offical notice's saying you cannot park then you can park near someones driveway. Some people think when they buy a house that they buy the road as well.
We have a dropped curb to a private house and live near to a station. Before permit parking was introduced a few of us had trouble with some drivers parking across the drives. I agree that I do not have a right to the section of road in front of the drive and we resolved the problem in our own way. My eventual point is that on speaking to the police we were told it is not against the law to park across any empty drive but if you block a vehicle in you can be prosecuted for obstruction.
If your driveway leads straight onto the public road, then yes.
Anyone can park on a public road. The space in front of your house does not belong to you.
