On Friday my hubby was dismissed from his job. He was in a 6 month probationary period so he cannot dispute the dismissal. However, he was given one weeks notice and when we checked his contract, it clearly states that during his probationary period, he should be given (or give) one months notice. Does anyone know what rights he has in this situation? TIA.
You take a copy of the contract and write to the firm saying under the contract they owe him three weeks wages, please can you have it
If he was unionised which it doesnt sound as tho he was, then the union will help
if they dont it is the industrial tribunal - under the subject wrongful dismissal (and not unfair dismissal) altho I pursued somehting close to this in the small claims court as breach of contract.
You could always try contacting ACAS - I've found them really helpful in the past. And if you have a case, and your hubby's ex-employer aren't forthcoming, they can offer advice/help on how to proceed.
Contact a solicitor. Some will discuss what you can do for free and then if you do anything about it there is all kinds of help with fee payment availible.
gleaveyweave,can't help but sounds like you have a good case to me ,love it when a firm get it wrong and you have a good case,on the other hand they may settle out of court if they are approched,good luck and stick it to them girl.
Thanks for all your answers. I had a look on CAB online and the first thing to do is as Peter said, write to them and ask for the money, it's only if they refuse to pay that it becomes a legal matter and i'm pretty sure that his boss will just pay up as he won't want the hassle!
