under old rules csa tribunal is considering whether to allow a deduction for business lease payments. They will only allow replacement assets and whilst each piece of equipment was similar to the one that it replaced in terms of specification sometimes new items replaced items which had been purchased second hand and they are wondering if this is enhancement rather than replacement. Help needed. Any past case law out there that somebody can point to.
