I got caught happy slapping some drunk old bloke asleep on the bus and he fell and koncked his head, also it wasnt my idea it was Daz.

Can I say im not guilt becasue it was the guys fault cos he fell, i only slapped him?

i could say he might have fell cos he was drunk. its against the law being drunk, so i could have him arrested.

How do you know he would not have fallen over if he was sober? You caused him to fall by slapping him. How can you possibly plead not guilty given that you accept you slapped him in an unprovoked attack just for fun?! In any event, you have still committed an offence of assault by beating - common assault (if not assault ABH, which will depend on his injuries). You need to accept responsibility for your actions. Own up and plead guilty at the earliest opportunity. And Daz is as equally guilty as you - if the CPS charge it as a joint enterprise, it doesn't matter who slapped who. Plead guilty and grow up!!

Of course this has nothing to do with the OP as he was on a bus & not in the pub..I was just informing you that it IS illegal to be drunk somewhere else :o)

It is not illegal to be drunk in a pub (or anywhere else), pippa. For one thing there is no definition of �drunk� in law. The definition applied to drivers is having excess alcohol in their blood (above the prescribed limit). It makes no reference to being �drunk�. As has been said, �drunk & disorderly� is a different matter.

You may be confused because licensees are prohibited (by the terms of their licence) from serving alcohol to four classes of people in their licensed premises: People under the prescribed age limit; a police officer in uniform; a working prostitute; and someone who is drunk.

Think on this - if you had "happy-slapped" (what a term!) someone under 16 you'd probably be in prison now.

Well I would suggest your best line of defence is to argue that none of this is your fault. Presumably you had an unhappy childhood and now stay at home watching expensive cable TV (apart from on Mondays when you go out to spend your giro), because no-one will give you a job because you are an illiterate moron with a string of previous convictions. Every time you do manage to get a job, you either knock off the petty cash or you end up inside for some petty offence which wasn�t your fault and the Court/jury got it wrong. Having to stay at home like this (because of your ASBO preventing you from going out), you come under the perverting influence of daytime TV or your mate Daz who just pops round on his way home from knocking off some poor old lady�s pension. As a consequence you are so terribly bored with your life (your probation officer suggested going back to college or doing voluntary work, and you ended up giving yourself a hernia laughing) you decide to wage war on the drink that is invading our society. The only way you can save yourself from abject madness is to go around �happy slapping� innocent old drunks on the misunderstanding that it is highly illegal and dangerous to be sleeping off a few pints on a bus. That should do it. No problem. You may even get a good citizens award. Remember, you are the real victim here.

Whether he was drunk or not, you slapped him. This amounts to Common Assault. How would you feel if you were slapped (not to mention fell and hurt yourslef even more!) You deserve what punishment you get frankly!

Happy slapping is part of the culture, its just old people that dont understand it because they dont like it.thats my opinin anyways.
