Selling on of debt
If a major credit card company sells on a debt to authorised collection agents, where do I stand regarding monthly repayments.
I received a CCJ against me 12 years ago and a payment plan was worked out at the time. I have been paying more than the amount requested so the question is, can I continue to pay this amount or can the new agents request more.
I am a disabled person living on a fixed income but have never missed a payment so far.
Any guidance grateful.

For more on marking an answer as the "Best Answer", please visit our FAQ.In the UK debts have to be collected within 6 years so if this was 12 years ago I would not worry about it but dont let the new agents bully you into paying more as they often do this.
I would say that after 12 years you have paid your dues anyway so try and work out what you have paid and what the balance is if any.

There is a CCJ which will have been for you to pay at a certain amount per month. You have been paying that amount or more without fail. Provided you go on doing so until all the debt has been paid off there is nothing the creditor (or the new owner of the debt) can do by themselves. They cannot force you to pay more. To do so they would have to get the Court to change the terms of the CCJ. I don't think they have the right to apply to Court to do this (but am not certain). If they can, and do so, you will have the opportunity to give the Court your financial details to help them decide whether the payments should change.
keep paying the amount agreed at the time until the debt is paid off. Although the statute of limitations applies to debts over six years old it only applies if you can prove you have not received chasing letters from them. if you have been continuing to pay the debt you cnnot deny that knew about it.
I recommend you keep paying, although you could also ask them to be released after twelve years on the basis that most IVA's are five years only.
