I have heard that people in Scotland can't claim back their illegal charges from the banks for more than 5 years. Is this correct and why is this the case? I am still slowly paying off charges from 6 years ago....
The provisions for recovery of unsecured debt in the Laws of England and Wales are found within the Limitations Act 1980 and has a time limit set at 6 years.
The equivalent law for Scotland is the Prescription and Limitation (Scotland) Act 1973 and has a time limit of 5 years.
