where do I stand
We are seperated but husband pays mortgage. He was coming and going as he pleases but things changed and I asked him to come only when I was at home. The only time I don't want him there is 8-30 till mid-day. He says as he is paying mortgage, he should be able to come in anytime he wants. My solicitor says I am not being unreasonable but he is going to see a solicitor on Monday and says he will file for Divorce. Am I within my rights to state I don't want him there when I am out. Anyone know

For more on marking an answer as the "Best Answer", please visit our FAQ.The normal rule is that, if you are joint owners of the property, he has as much right as you to be there - he could even insist on living there. The exception is if you have a Court order barring him from the home. Your solicitor is the best person to advise you on your particular circumstances, but I am not aware of anything that would chnage the above. (Whether what he is wanting to do is reasonable in the circumstances is another matter.)
