My holiday cancelled at 35hrs notice

booked 10 months ago, now Thomas Cook say they overbooked the accomodation, what are my rights? I am going in to see them in about an hour when my friend get soff work, i have taken a day off to sort it, we fly at 4am tomorrow but obviously that is now gonna change, what can i expect? It was a 5 star AI Riu hotel and we want similar.

Gotn a full refund but now no hols Gina, i have been packed for a month! Had my nail art done too, what a bloody waste! I am fuming at this shower of a travel company, they would only offer my friends �25 compensation, according to the small print in the back of the brochure that is all anyone gets.
what a joke,im sorry you have lost your holiday i bet you went mad at them. can you not book a last minute holiday, maybe get more value for money. did you get any compo?

i am looking at Paphos for a weel end of July now, with my daughter, but it will be from anywhere but Thomas Cook, they are a joke!
I always avoid Thomas Cook like the plague ever since they did me on the exchange rate in 1963!!
Thats awful,i had a similar experience with Thomas Cook a few years ago,my son was gutted when they cancelled us 2 days before going.We got a refund and went to the same place with another holiday co and it worked out cheaper and we had better accomodation.Its annoying isn`t it!

annoying is not the word, two years ago i lost a holiday through the hurricanes, but at least that was a reasonable excuse, this time it is down to the sheer stupidity and unprofessional attitude of Thomas Cook, would anyone like to imagine the content of the string of emails I have fired off to them tonight? If i held onto someones money for 10 months and then told them they had nothing to show for it i would be in an arrowed suit, they are high street bandits.
They gave me the overbooked crap as well.
According to the 'Package Tours Regulations':
(4) In the case of damage other than personal injury resulting from the non- performance or improper performance of the services involved in the package, the contract may include a term limiting the amount of compensation which will be paid to the consumer, provided that the limitation is not unreasonable.

I really would take issue with being offered a paltry �25. While the iron is hot, go and see them, and explain that this pathetic sum is incomparable to the loss of wages otherwise earnable, disappointment [vexation] and other percuniary expenses. Tell them that unless a reasonable sum is offered (Calculated honestly by your good self) you will pursue this matter further. Make sure you follow up on the threat! Good luck.
Right, lets assume your holiday cost �1000. Using the Bank of England Base rate +2% (not unreasonable IMO) the interest you have lost is around �60. On that basis, and without knowing how much you paid but I guess it was more than �1000, their limit of �25 is unreasonable as far as I am concerned. They are not even putting you back in the position you would have been in before 'lending' them your money, let alone compensating you.
