Hi hope that you might be able to help me out on this one.
I was driving home anout 7 months ago and turned left giving plenty of indication of course.
There were a few people standing on the kerb waiting to cross the road as I turned left I heard a bang and realised somebody had stepped of the kjerb and fallen into my back wing.
I parked and went to help the person and called an ambulance, It turned out that what had happened one of the pedestrians told me that this bloke was blind drunk and staggering and he fell of the kerb twisting his ankle in the process and fell onto my back wing. the police and ambulance came and they all could see that he was drunk and stunk of drink. and no further action was taken by the police.
I recieved a letter from one of these no win no fees soliciters today stating that there client was halfway across the road when I turned left, which of course is a complete lie.
According to them he fractured his ankle and suffered other injuries and want my insurance details etc. According to them I must give them my details by law which I dont think is right, is this true.
I dhould have taken one of the witnesses name and address I know but did not think at the time,I had a passenger in my car at the time my son and he also saw what happened.
Have any of you any idea if this leach has got a leg to stand on. (sorry about the pun).
Manny thanks...

I agree with above, you did everything right at the time and the fact that the police attended and found no need to follow up bodes well. They will have records and notes of the events and that should show that at the time the guy was drunk and you did nothing wrong.
Hi k9 :o)
Was there any damage to your back wing k9? Did you have it repaired? Because if he had already been walking across the road when you turned left then surely there would have been damage to the front (or front side) of your car not the back wing?
Sorry if I have totally got the wrong end of the stick here (I tend to do that from time to time! lol)
For there to be damage to the back side unless you were reversing backwards at the time (which obviously you weren't) then you must have already been going past when he fell into your car.
If on the police report it states damage to the back or you have a garage invoice for repair to the back wing, I would send copies to the solicitor saying explain how the damage is to the back side if he was already across the road when you turned!
Speak to the police and see if you can get a copy of the report.
Let us know how you get on!!! Be interesting to see how this pans out :o)

Hy and thanks for all your replies have only just had time to read them.
Joko, by the time the police turned up all the witnesses had gone (apart from my passenger of course). and the leech had already been carted of by ambulance, one other thing if he tries to say he had a witness Ie one of his mates lyong then he did not get the chance to talk to anybody before he got carted of as I was with him all the time. and did not move him as instructed by the people who I made the 999 call to. And he was still lying there when the ambulance came. And if he trys to make out if one of his mates where there at the time shen he has just shot himself in the leg hasent he, as his friend would habe tended to him as well and go in the ambulance.
Whickerman will phone my insurance tommorow.
Rev agree 100% with you.
Furry and gree the same with you.
And wingnut its ok you have got it right and know what you mean thats exactly what I thought , the police did look at my back wing and in the dark under the streetlight it did look like there was damage there but in the morning there did not appear to be any.
I suppose that I know really that it has not got a leg to stand on but it does worry you a bit.
Thanks all again and will post back when its settled.....

Hi, you do not have any cause to worry. First of all contact both Police and Ambulance Service, give them the date/time/location and they will be able to confirm the mans state at the time. They will have a record of their attendance and treatment etc. Also, had you been in any way responsible for the accident you would have been prosecuted. Unfortunately, yes you will have to give details, however, when you do, explain that under no circumstances do you admit liability for that persons injuries and if they proceed with a claim you will call the Police Officer(s) and Ambulance personnell to state in court the condition of their client
