Unfair dismissal???
Hi,
I was given my notice at work this week...kind of out of the blue. After 3 months, my probationary period was extended to 6 months, after which period I was made a permanent member of staff. A month back my MD and line manager expressed some concerns, comparing me to people within the organisation who were younger and that it was unfortunate for myself that all other new joiners were of such a high standard.
I was told that I have been acting very professionally but in terms of the future vision for the company, I do not 'gel' with the company.
What are my legal rights here? Do they need to prove that I am incapable of doing my job because I can't give up lightly...I have just moved into a new house and, like everyone, have bills that need paying.
Am I in my right to ask for a pay off or do I take it to an employment tribunal?
I am gutted they have treated me like this but I know what I am worth.
I would have been in the company just under a year by the time I leave so am aware that I don't have full rights but what rights do I have???
Any advice very much welcome.
Thank you in advance
Sarah

In normal circumstances, an employer can terminate your employment within one year and there's nothing you can do. However, I notice that you've said something about others being younger?? Could this be age discrimination? If it is you need to seek professional advice as you could well be on to a winner! Having said that, it is very frustrating when you're working alongside someone who is nearing retirement (not suggesting that you are) and who clearly works at half the speed of everyone else - it's not very productive, so I often sit on the fence over this age discrimination thing - not sure if it's good or bad.
Unfortunately, from what you say, you don't have a case. As you rightly point out they can dismiss you within the first 12 months of employment without giving a reason. The fact that they said you don't gel with the other staff and that newer employees are of a higher standard than you is enough.
You should have received pay for your notice period, probably 1 month.
I think you'd be wasting time and money trying to prove a case based on what youve said here.
