I was wondering, in the telecommunications workplace agreement of Australia, is it possible to get fired from your workplace if you have been charged with talking on a mobile phone? Because I was told when I first started a job at a call centre that it was a sackable offense to get caught driving whilst talking on a mobile phone. Yet I have been told by other people that it is not possible to monitor this without breaching someone's privacy.

You would be better posting this question on an Australian based website, this one is UK based and we don't know aussie laws.
it's illegal to drive while talking on a mobile in the UK though I don't know if the millions of idiots I see doing it are ever punished. One woman was punished for eating an apple as she turned a corner, though. Anyway, your company may well choose not to employ people if they acquire criminal convictions if this is also illegal in Oz (I should be very surprised if they can do it just because you've been charged, though; you might be innocent)
