January 2007 I purchased a property with my partner of 1year. We are tenants in common. I haven't been able to find a job since we moved and haven't paid absolutely half of the mortgage - this was OK with my partner until now because there are problems. Prior to moving to the property he lived at my house absolutely rent/mortgage and bill free for a year. The deposit for this property was obtained by me decorating his house for 3 months and maximising on the return profit - achieving �23K through enhancements of which we agreed that we would split 50/50. I didn't take any money from the sale and requested that he put it forward as my part of the deposit for this property.

He has just assaulted me and I want to get away from him but I don't want to lose out on my home. I am living at the property, he is staying with a friend - we are both paying half the mortgage but that will be difficult for me going forward as I am not working due to stress.

Where do I stand?

Is it a joint mortgage? What does your tenant in common think you should do? You may have to either buy his share by giving him the equity or sell up if you cannot do this and he wants to sell. Did you write up an agreement of trust when you bought the house a tenants in common?
