Maternity leave/pay

I am due to finish work around February of next year to go on maternity leave. However I have not yet decided if I shall go back to work. If I decide not to go back to work but have been receiving maternity pay from work for, shall we say 6 months, will I have to pay back every bit of the maternity pay for that 6 months? I work of the council by the way and have been in my job for just over a year. TIA

For more on marking an answer as the "Best Answer", please visit our FAQ.If you qualify for Statutory Maternity Pay (SMP) you'll get it for 39 weeks and it does not have to be repaid if you do not return to work. If you are entitled to Company maternity pay, it may be in yir contract that you have to return for a minimum period and if you don't, the balance between that and the SMP would have to be paid back.
