is it illegal to park a car accross another pesons driveway, the kerb is dropped and there are double gates, but very often I can't get my car out early morning because of people doing this.

as far as i know, they are not allowed if you own your property, they need to leave you access.

If you have a dropped kerb, they can't block across it. Contact your local council - highways. Whether you own the property or not is irrelevant.

Not certain,but was told years ago providing you are Taxed,Insured etc.you can park where you like. Crazy,if it's true.

Ah, but ethel i see this applies only to special enforcement areas, Which appear to be in Greater London,

I read it applicable to the whole of England and Wales:

The prohibition in this section is enforceable as if imposed�
(a) in Greater London, by an order under section 6 of the Road Traffic Regulation Act 1984 (c. 27),
(b) elsewhere in England and Wales, by an order under section 1 of that Act.

But look at s86 (9), which says it is also enforceable in the whole of England & Wales if imposed under Section 1 of the RTR Act 1984?

It was very difficult to enforce and offence for parking across a drive because the obstruction offences - wilful and unnecessary - apply to the highway. Clearly blocking a drive is not obstructing a highway as the road traffic can still flow.

I suggest logic contact both the traffic police and the local council to see if this 2000 legislation is applicable to where he lives and if not, why not?

I live near a large school - when they are picking their children up they just park anywhere (even on front of peoples drives). Once or twice i have gone out to them (when my daughter needs to get off the drive). I have been given loads of abuse and told to wait - one man showed me his disabled badge and shouted abuse at me - so now i can't be bothered going out - it's too mush hassle. I phoned the police and they told me to take their numbers and phone the trafiic wardens. I phoned the traffic wardens and they said although it is illegal, they cannot come out to book these people or it will look like victimisation toward the parents - so i can't in. My local councillor is a load of crap and so are the local council (Shaw and Crompton).

Not only do they park in front of my drive, but our road as a parking ban between the hours of 8am and 6pm (they are parking between 3 an 4pm). So it's a double whammy, but noone will do anything.

If you hit them over the head with a bat then i am sure you will be arrested and charged with sct18 - but i would not advise that.

I seem to recall from years ago that there is nothing you can do about it. A persons property does not include the road. Now it is ignorant to do such a thing, however there are these type of people out there. What we "burly" blokes used to do in Croydon when someone did this to our drive was to simply to bump the car up onto the pavement - then simply call the police and have them towed away for causing an obstruction to pedestrians. Not ideal but perhaps they will get the message.

get some cones and use them. Or accidentally let the air out of 2 tyres per car for a week.

cones are the definite answer. i park on a street every morning where there are civilian homes with on-street parking as well as driveways and if some1 doesnt want you to park in front of their drive it is made clear with cones (or some have a sign saying no parking). Only ignorant idiots ignore either of these two measures.

I had this problem ... our house is close to the town centre and is regulary used by office/town workers as a car park...

One day, a silly woman.. parked out side my house and her car overhung my drive by 12 inches... I was stuck and could not get out..

I called the police...( not 999 .. the local number)... they came out... issued a �60 fixed penalty and bumped the car away from my drive.

I also know some people have affixed clamping notices to their property theatening clampimg and costly removal charges... However, not recommended... am unsure as to the legalities!!!!
