can the c s a force sale on my house ?
i do owe them money because i was giving my x cash and have no proof now they are trying to get �27,400 out of me which i do not have the money to pay thats why they are trying to force sale on the house can some one please help

But why the hell haven't you been paying for your child/ren anyway? That is a lot of money to owe and I hazard an educated, actualoly uneducated guess, that amount hasn't grown to that over the last year

bronners, the csa will claim if the person was on benefits and did not declare the maintenance as income.
scano, how was the amount owed arrived at? The normal rate is 15% of your net salary. The amount claimed might have just been plucked out of the air to prompt you to do something. Go back to them and ask. Also, have you no proof at all that you have been paying maintenance - statement debits or anything like that?
This would be unecessary if you talk to your ex and get her to talk to the csa. Any chance of that?
And no, it is unlikely that they will force you to sell your house. You couild pay it off monthly.

Going by post 2 you have been here before saying you have been giving your ex money in the hand? Rubbish. Because *if* you had been doing that you would have stopped as soon as the CSA became involved - I do not believe it
You do not get a debt of almost �30,000 over the course of a few months, this has been going on for years
As for the benefits issue; if you are on IS then the CSA become involved as standard and they will know how much has been paid, by whom to whom if you do it correctly. If the ex is on tax credits, maintenance is NOT taken into account as an income ergo she can legally not declare it as an income

I was asking the age of the child as it might give me a clue as to:
A) If scano41 is on CSA1 or 2 ~ both are different regarding formulas. CSA1 is a long winded and unfair scheme, with up to 40% taken from source. CSA2 is a basic 15% of earnings.
B) How long the arrears have been going on.
I know how easy it is to build up arrears with the CSA, For starters it can take 6 months + for them to contact you for assessment. The assessment date starts when the parent with care applies to the CSA. Already you are 6 months+ into arrears (bearing in mind an assessment of �400 per month, you can do the maths ;o)
It is up to the non resident parent to prove they have paid cash to the PWC. The CSA usually believe the PWC if they say they have received nothing. In the meantime arrears are building despite payments made....
Assessments are invariably incorrect. When an incorrect assessment is made, you have the right of appeal. Appeal process can take up to 2 years to complete.
Now you can see how a figure of �27,400 is feasible in the eyes of the CSA. A recent case highlighted how a woman with shared care of her children had a bill of �75,000 in arrears, over approximately 10 years. After a long process of deduction the CSA admitted they were wrong and sent her a new bill of �16,000.
Quite a difference, eh? assessments and arrears breakdowns must always be checked and double checked.

i quite agree with you pippa, to be honest i think the csa is a waste of time and money.i know a few people who have had to have dealings with them,and at the end of the day none of them have been happy with the end result.and these are people on both sides,so what is the point of the csa. i think the majority of people were happier before the csa came along and started sticking it`s beak in.

Surely you pay the �400 pm (which is not a lot for raising a child) and go without rather than pay half then worry about the up coming debt?

We do not know whether this poster hasn't paid any money. I would give him the benefit of the doubt as his story is a common one. Plenty of parents with care take the cash and then say they haven't received anything.
Child maintenance is vital. Of course it is. However the CSA have NOT reduced child poverty. On the contrary they have made more children poorer than ever. Why? basically because the only cases they are interested in are the ones who are on benefits ~ as the money is owed to the Secretary of state and not the PWC.
When a man can earn a good wage and only be left with income support rate because that is the CSA formula, it is a poor show. Poverty is then spread across the board.
The old court system was easier, which is why the CSA will be going back to that system by 2010. It won't come a day too soon.
