when a married couple are getting a divorce why is it when there are kids involved the mother or father always gets a bigger share of the family home when sold eg 60/40 or sometimes more does this share go to the children or does the mother or father get this ?
It doesn't normally go to the children. If the house is sold whilst the children are still minors, the parent they live with must be able to accomodate them properly, and the share as the assets reflect this.
If the children have left home, then different criteria is used. Often there is a straight 50 50 division.
