Help ! Mobile Contract - Please?
I went into CarPhoneWarehouse today, as my orange contract is almost up, to ask what deals they could do for me now. I was told by the salesman (after he checked my account) that Orange wouldnt do a good upgrade and I was better to take out a new contract from scratch.
I signed up for T-Mobile on a new contract.
When I got home and called orange to obtain my PAC code to leave them they told me what my upgrade option was and its far better than the new deal I was talked into buying.
Where do I stand legally on the new contract I have signed, the shop now say 'tough you signed it'. I am annoyed at this, I have been misled by their advice and will lose money on this deal.
Any help gratefully appreciated.

yeeee ha, ive been informed by T-Mobile that i can cancel this within 7 days and I have taken the guy's name. He himself has taken the CPW phone number to confirm this so let this be a lesson to wee me for the future.
Also, handy to know for any others out there who feel miffed about these sales techniques.

yeah Cruella, its not even ON the small print, these guys just rake in their commission and tell you what they like
they definitely told me that T-Mobile would NOT accept the cancellation, Nathan told me on the phone immediately that I have 7 days to cancel. The contract is only 3 hours old !

You certainly have 14 days "cooling off" period, and it's not just O2 that do this, it's your statutory right to cancel a contract. Basically it's to stop pushy salespeople telling blatant lies, although it doesn't seem to stop some of them. If CW continue to refuse to cancel your contract go to Consumers advice, or Citizens advice bureau.

I went into the CPW store today and the manager point blank refused to cancel this contract. I am so furious that I am physically shaking all over.
He phoned T-Mobile whilst I was there and they confirmed that cancelling it would only lose them their commission, but he stated that he cant take the risk they wont charge CPW for the whole 18 months. When I said that was b0llocks he disagreed and thanked me not to talk like that (oops). I have come home and obtained the email address for the top man Charles Dunstone and am firing off an email message (politely) marked urgent.
God I hate phone shops.

i would head to the shop again and ask to see the manager or senior salesman dont be tempted to sort it by going into an office do it in the shop and talk loud make a massive fuss when the shop is full, saturdays will probably be best, they wont like it one bit. the suggestion of going to ofcom is a good one, tell them you were mis sold a contract, carphone warehouse have a stinking reputation for customer service and not informing people of what the contract is (personal experience here)
Go in there and speak to the manager face to face , tell him unless he wants to be on BBC's watchdog in the next few weeks he needs to consider sorting it out for you and disciplining /retraining his member of staff who obviously is commision driven to make the sale , in a nutshell , he would have sold you mud on a stick if it earned him more cash ..... if that fails a day standing outside talking to customers and advising them of your bum information , you cannot beat direct action with the help of your local rag covering the facts ...it works....
Hi again, write a letter, go to consumers advice with a copy, send a copy to the shop, cpw head office and T mobile, telling them of your situation and the lies you have been told. Take a witness with you to the shop and demand they cancel. It is your statutory right. If all else fails, I have a baseball bat I can lend you.
I've heard nothing from the top bloke at CPW as yet, so to comply with my apparent 7-day legal right of cancellation, I had better send copy letters tonight to T-Mobile and EFCOM, recorded delivery of course.
