My brother and I are tennants in common with our mother in our family home.
She is now undergoing an assessment by the local authority(scotland) to assess if she will qualify for assistance in paying for a care home. because she is a tennant in common will her share of the house be taken into account in her financial assessment.

In short Yes.

However it maybe possable for her to receive support at home and not within a care home and your local Council may also favor that as it may cost them less.

A welfare rights officer at your Local Social work Dept should be able to explaine. The options available To you and your mother. ( costs nothing)

CAB will also advise on options . ( again no cost )

At the end of the day i dont know your situation and can only give some pointers and the lawyer route can cost lots.

I am aware of this as i have delt with simmilar situations over the years.

I am also Scottish and aware of how local councils can take everyting off the elderly when entering care homes.
