Hi postdog I think you misunderstood its not my fence that needs repair it is the one at the BOTTOM of by garden it actually cover three other houses It is very difficult to get legal advice from citizen advice most have closed down Any other suggestion would be gratefully recieved
You don't NEED to make different posts each time . Just add to the one you have made as it gets very confusing (obviously) getting info from more than one post about the same thing.
Hi Bayliss, me again ! OK, we've got the picture - you do need some legal advice - what about your insurance company (buildings) - they might be able to suggest something.
PS - you can post back on your own thread - it keeps all the issues in context and in one place :)
I think I've got it right - the fence at the bottom of your garden belongs to the Council (I am assuming they agree this is the case) but they won't repair it.
I suspect you will find there is no way you can force anyone to repair their fence; if I'm right on this then you won't get anywhere through the legal route except a confirmation that this is the case. You could get a solicitor to write the Council a letter about it, but the Council will know whether they have a legal obligation and could just ignore it if they haven't.
Have you tried involving one of your local councillors? They might be able to bring some pressure to bear on ther council officials.
It doesn't really matter who the fence belongs to - in most cases the owner is under no obligation to maintain it. If he wants he can remove it altogether.
If you want a fence put one up, just on your property. Better money spent on that than on lawyers.
