I have legal right of way and access to the rear of my property for over 27 yrs I have maintained the land to the rear of my property as well cleared weeds rubbish and now drug needles and such. because of the way the land lies i have severe flooding to my property on a regular basis. the land is unregistered and does not belong to the council. do i have a right to claim it ,fence it off so that i can level it out to stop the flooding
There is a law where you can fence off and claim unregistered land. I'm not 100% sure of the timescale but I think it may be 7 years.

You could alternatively locate the owner of the unregistered land to purchase it or at least discuss the option to level it off. There are a number of companies that do it but i would recommend contacting the company before you order. Search for "Unregistered Land Specialists" in any search engine.
