speeding fine(england)

A friend has told me that he has received 2 different speeding fines on the same day with a lorry and he said it stated he was doing 31 mph in a 30mph area. I personally think he was doing more as I thought you got a leeway of about 2 to 3 miles.When I mentioned this he said there is no point in arguing with them as they will only check out the trachometer .This is why I think he was doing more.Any comments on this please.

Guidelines issued by the Association of Chief Police Officers suggests that a fixed penalty for speeding should not be applied unless the speed is 10% + 2mph above the speed limit. For a 30mph zone this is 35mph.

This is so as to avoid arguments about instrument calibration and so on.

Generally prosecutors do not have access to tachograph information when dealing with speeding offences, nor should they need it. They usually have ample evidence to support their allegation.

It is most unlikely that your friend has been accused of speeding at just 1mph above the limit.
