Lost reciept

My american style BEKO fridge freezer broke last month and beko sent an engineer out who was unable to repair it, he said it would be replaced. now beko are saying that because I cant find my reciept(I bout it from Watford indoor market in the middle of january) they will not replace it even though they have admitted to me one the phone that they can tell its age by the serial number. I have today made a county court claim against them, does anyone know if they have to replace it still?

I would imagine so. Surely, it's unfit for the purpose for which it was sold under the Sales of Goods Act.

Ok, you purchased it second hand from an indoor market, so I assume you paid cash ?, or was it on a credit or debit card, you see where I am going, you can track the payment, if you paid by card.

Sometimes markets sell equipment that has been repaired or returned to companies with faults, these graded items are still covered by the sale of goods act, unless stated otherwise.

If it was purcahsed second hand, then I assume the buyer may well of filled out the warrenty form.

However sometimes the warrenty is made void by another person not authorised to repair doing a repair.

I don't know how the transfer of goods and their warrenty is affected, but all goods are numbered, so the track back is easy for a large company.

I would go straght to your local council trading standards team and ask advice, or pop into the local citerzens advice centre.

It was brand new boxed the guy was doing an exibition
How did you pay ? - Card or Cash.

Doe's he trade regually there ? - Can you find out from the market management the guys details ?.

Brand New - Did you send off the warrenty form ? -

Have you had anyone else look at the fridge ? - Everything made in this world is fixable Matt.

Not all engineers make the correct judgement on equipment.

It was bekos engineer, and yes mate i paid cash i live 80 miles away from watford

Ask another engineer to look at it.

Have your day in court.

It's only 6 months old you may be lucky.

I'm not going to let them beat me, I have just completed my claim online, I think they are just trying it on, my mate thinks that by them sending an engineer they have already accepted liability

The lack of a receipt will not by itself void your claim. Have you still got the packaging? Did you get the cash from an ATM in Watford and have you still got the receipt? Did you buy other things in Watford on the same day that you HAVE got a receipt for. ? Does the seller remember selling it to you? If so get him to write you a letter confirming it. As much evidence as you can muster will impress the judge. The proof required will be on 'the balance of probability' for a civil case, rather than 'beyond reasonable doubt' (criminal case)
