A friend of mine was pulled by the police by taking a left turn where she shouldn't have, they asked her to produce at a local police station. Her MOT is out by 2 months. What action will be taken? Gemma
Actually it is the offence of driving without documents and can be a summons to court with a fine and points.
The fact it is out of date would be a failure to produce the document plus there would be court fees, for the hearing at court, if it went there- this from a police officer
It is not driving without documents - there is no such offence.
It is s.47 of the Road Traffic Act 1988
s. 47.
Obligatory test certificates.
� (1) A person who uses on a road at any time, or causes or permits to be so used, a motor vehicle to which this section applies, and as respects which no test certificate has been issued within the appropriate period before that time, is guilty of an offence.
