is it legal for a non driving job to require the applicant to drive?

i just enquired about a job, and they wont consider me unless i have a licence and my own transport? surely this isnt fair?

its for a management position in a restuarant chain???

Well isn't there some lovely people on this site!! I can see your point but I guess its entirely up to them who they employ, if they want you to have a license then thats the case. It doesn't make sense though.
Look at it another way.

Hospital needs a doctor. Would you think it wrong for them to only consider people who are qualified in medicine???

Jobs require certain skill sets, so if you want the job, you have to meet the criteria.

The issue here is that the job you're going for may not require you to drive frequently or maybe ever, but if the restaurant is part of a chain it may come in handy. They may know that from time to time they need to get a manager to cover more than one site for short periods and the only sure-fire way of coping is by your driving between sites. Restaurants can open early and close late. They don't need the hassle of your turning round and complaining about the lack of public transport at 2 in the morning.

it was a serious question, maybe to you this seems ok, but i was just wondering if anyone could tell me the legalities, maybe i was being a bit disgruntled that i was told i couldnt work there without a license, but why should i put up with insults? if you couldnt answer with a straight answer then why bother answering at all?

and seeing as i was going for a job that was VERY local to me and within 3 minutes walk from my house, i was shocked when they turned me down for this,

it seemed to me to be descrimination of some kind, after all, if they wanted me posted at another outlet then its probably their responsibility to pay me expenses anyway, and im sure a cab wouldnt bankrupt them if needed...

just seemed a bit strange.
Tetjam insults everyone equally - you are not being singled out for special treatment.
Everyone else was reasonable, I thought. It is unfortunate, but the company can ask for this in their job criteria, almost certainly for the reasons outlined.

Daavedave - there are some total a$$holes on here, who hover around certain areas of the site just to post a completely ridiculous and sometimes insulting reply...so please just ignore them - I think it is an attention seeking thing !

If you are really keen on the job, then it may be worth speaking to them again. Explain that you live locally so normal journeys to and from work would be no problem at all. Maybe also say that you are aware there may be occasions where you would need to travel to other locations, but you are more than happy to do so via public transport etc, so long as you could expect reasonable expenses (as most companies would normally pay if you were driving to another site).

NORMANTHEDOG - I have a life... I was offering a constructive response. Some people on here are actually looking for genuine responses, rather than the responses from some of the idiots on here who seem to gain pleasure from ripping into anyone they can with rude and pathetic responses.

If you don't have anything constructive and worthwhile to say, why not just crawl back to wherever you came from. I can only assume people like you were bullied as children, and use this forum as some sort of sick payback.

The (mis) judgements people make of you are particularily bad in the Law section.

There are employment laws regarding equality and other issues, but the need for a driving licence, and often a clean one, can be a prerequisite for a job...There is no law regulating this.
