Hi, I wonder if someone out there could give me some advice please.

I asked a web designer to design me a new website to contain certain discount codes etc he promised faithfully that it would be done in a month this was in June and it still isn't done.

I explained to him in August (1st) that I was closing my retail outlet and that the website was a priority as I need something for my customers to be able to buy from he told me if would be up and running that friday - still nothing.

Althought the website said open my customers still can't buy and half the site and products are missing - he told me that it would take a week - still nothing.

As the dead line was approching I decided to source the work out to someone else - as I was sick of being fobbed off and chasing him, which he said wasn't a problem. But now he is saying if I dont pay the full cost for the website he will take me to court as it was me who cancelled it when it was just hours from being completed.

No contract was signed, nothing written down, etc and surely I am within my rights to stop any further work being carried out after I have been let down by him for so long.

You're well within your rights to stop any further work being completed. But unfortunately you should still have to pay for whats been done so far.

Given the number of deadlines missed, its likely that you can come to some arrangement below the full amount.

Unfortunately, however, if this person was making a full e-commerce system for you, it may well be that 95% of the work was complete before you pulled out. Adding products and design tweaks are usually left 'till right at the end.

You need to come to some sort of amicable arrangement with your webby. If you don't and get taken to court, I expect you'll be told to pay something in the region of 70% of the orignal agreed price.

Yes it was a full e-commerce site - price �100

Some products were added but half the site was missing, no contact details added, and shopping cart wasn't working, and a lot of products didn't have pictures. So it was far from being completed.

When I told him that I'd found someone else he emailed me back and said "ok not a problem and good luck" I didn't find a new designer until I knew where I stood with him first.

He's turned really nasty now so I doubt that we will be able to reach an amicable agreement.

A full e-commerce website from scratch for �100?! The price alone should have rung alarm bells. This should have had a 0 on the end at least.

He was promoting his business in the local area helping out local business' - 100 website for 100 business's for �100 each, others dont look too bad, just unfortunate he let me down.
He was looking after 99 other websites? He's stretched himself far too thin. To be honest, I'd draw a line under this and learn from experience.

No way can one guy look after 100 websites properly. No wonder he was aways fobbing you off.

For goodness sake you tried doing it on the cheap and got stung. Pay the �100 and get one done by a reputable designer. It will cost a bit more but as you have found going for the cheap option doesn't always make sound economical sence.
