we were actually put here from a much larger 3 bed house, so a lot of our things had to be put in to storage, the housing association are now delivering all this back to us on tuesday, obviously i want all my stuff back so cant wait the only problem is we are hardly going to be able to move in here ( the house is a very small 3 bed and there are 4 of us here. we have told the ha this and someone is going to visit us next week re moving to a larger 3 bed it is actually dangerous for me now as i have already slipped on many occassions, there is no storage here and my wheelchair has had to stay in the shed since we have been here, is this a health and safety issue and does the housing association have a duty to rehouse me on disability grounds?

If the house is big enough for you, your family and normal everyday furnishings and can cope with your disability needs there is no duty to rehouse you. You can pay to store your excess goods.

If, however, you are unable to use a bedroom, bathroom and the kitchen because you need a wheelchair and it can't be accommodated, then maybe you will have grounds for rehousing.

A 3 bed house would normally be more than big enough for 4 people.
i have a few questions
1) if you have been managing without the stuff, do you need it? if it is not essential stuff like clothes, cooker washing machine etc then it wil probably be classed as just accumulated stuff, which if you were living in your own house you would have the option to get rid of if yu felt it left you with not enough room
2) if your wheelchair has been in the shed (how long for?) how could you say it was essential?
