recording conversations illegal

i know someone who is winding someone up on purpose you know shouting asbuse pushing all the right buttons etc and then only recording the reply obviously abusive back after being wound up
they say there going to use it to get a harassment order or use it against them in court to show they have a bad temper in a custody battle which is unfair
isnt recording like this illegal

(It's illegal to record a telephone conversation without the knowledge of both parties to that conversation, but it's perfectly legal to record a phone call if both parties are aware of the fact).
If you were to have a conversation with me (for example, if you were serving me in a shop), there's a very good chance that it will be recorded because I always carry a voice recorder and frequently press the 'record' button without the other person knowing. It's perfectly legal and long may it remain so.
