ABH on my fiancee
hope you can help me,im in court nxt week for ABH charges made by the CPS on my fiancee xmas day,
we went to visit family xmas day had a brilliant time got very very drunk,headed home in taxi, (i was so intoxicated i cant remember a thing) when i woke up i was in a police cell with an ABH charge over me with a witness my fiancee had a cut to her eyebrow and a graize on her nose,we both are struggling to remember much,the police say the taxi guy saw me hit her and so did another taxi driver,but ive never raised my hand to her in 8 yrs i had no markings on my hand,i cant see how there was to taxi drivers because we would of just got back,the cut on her head looked like it could of been caused by her hitting it on the wall,i may of pushed her away from me and her bang her head.
i only have a caution for abh befor this,which was for protecting my fiancee against her stalker (which he spent time in prison for).
ive no previous for violence and wondering what prison sentence im looking at?
would be grateful for any advice.

firstly go and sign up for counselling for your anger and alcohol problems BEFORE you go in front of a judge, then when you go to trial throw yourself on the mercy of the court explaining what a complete **** you are but that you are truly sorry, are addressing your problems and wish to point out that incarcerating you would NOT be in the interest of either you, your partner or your family.

You say you and your partner have been together 8 years. That is a very long time. My ex and I had a similar thing a couple of years ago. We did not split up because of that, we split for him cheating. Anyway, it was a really stressful time for us both. In the end he got 160hrs community service, and a hefty fine. If your fiance is on your side thats better than her being against you. You need to support each other right now, and I really hope it all works out for you.
stupid me, do you think that maybe the taxi driver had something to do with it? Have you discussed this with your solicitor?
How did you get to the police station? i.e. did the taxi driver ring the police? Do they have a recording of this call? Did your fiancee require hospital treatment i.e. would there be a record that could indicate how the injury might have happened?

natalie it was the taxi driver who called the police,he also went to my parents house saying we only had �8 on us and not the �40 fare,but when i woke up in the cells the nxt day i had �85 on me i would of had no trouble paying him, the police now say there was two taxi driver witnesses but i cant see how , it was xmas day on a quiet street,and all suppose to of happened that quick.
yes my partner had a cut over her eye brow which would of took a heavy blow to cause i.e ring on hand or something
i had no marks or bruising on my hands and nothing like this has ever happened b4, my fiancee was seen by the ambulance due to her of being knocked out,we both think she banged her head on wall but CPS are taking me to court because they say wot if id killed her,im not a vialent person in any way.

If you had almost �100 on you when you woke up (would the police not have searched your pockets then put in a cell???) then the cab driver was not to know this and maybe because you were drunk he did not, quite rightly, want to argue with you.
Did the 'fight' happen outside your parents house? Why did they not see anything?
I am coming round to the idea that actually the cab driver, not wanting to argue over the amout of cash you did or did not have on you, perhaps pulled you and your fiance out of the car and that is how she banged her head?? It's possible isn't it, especially as this other cab driver appeared from thin air on Xmas day - there can't have been that many people working that day that anoither driver happened ot be in the same street at the same time. What sort of coincidence is that??!!

i agree with you pink kitten,it was prob not a good idea arguing with a drunk person,when i said about the money in my pocket i mean when they gave me my stuff back,i did wake up with �20 in my back pocket.
it is possible about the taxi driverpulling us out but also i woke up with graizes down the left side of my arm i still have the scares and a bang on the head,but if the police thought i had beat my fiancee, they was prob a bit rough with me i cant be sure though.
i saw my solicitor today hes going for an adjourment on wed,so i will not no what the wittness said till then,my fiancee also saw 1 today asking for her statement to be retracted as shes unsure herself,if i have done anything im more than willing to do my time cause i dont belive in that type of thing.
