Hi there I was wondering if anybody knew, which of the 2 blood samples are used during a drink driving case.

I was breathalised about a month ago and blew 41 after drinking 2 pints.. 2 Blood samples were taken. One for the police to test and one was given to me for independant testing. I am not due back to the police station for 3 weeks, but my independant blood sample has come back with a result of 75 which is under.

If the police result is over 80 will they take the highest one, the lowest result or an average?

the police or whoever tests the blood sample, should, and are required to use the lowest blood alchohol reading. fact.

So just to confirm. For example if my independant blood sample is 75 and the police sample is 85 will my independant sample of 75 count? Meaning I get off?
The lower is the one which is used as evidence. You will be informed of whether or not any further action will be taken. I'm assuming that you are on Bail to return to the Police Station?
If yes, you will be told then what, if anything, will happen.

Yes I am on Bail so I guess I need to take the independant report with me then?

They always use the lower figure just as they take the lower figure on the intoximeter at the police station.
