My neighbours brick garden wall is seriously leaning over in the direction of my property. I have just booked my builder to put in a new drive for me and he advised that as he will be using a mini digger to uproot some trees on my property it will probably cause the wall to further lean and the brick boundry wall may topple over. On that advice I wrote to my neighbour explaining that his wall is in a dangerous condition and may topple over whilst work is carried out on my drive . He does not want to do anything about improving the safety of the wall and tells me to be careful What can he do if the wall falls over. I do not wish to rebuild a wall for him as he is to tight and never wants to spend any money on his property . and I also do not wish to fall out with him .I have taken photographic evidence of the lean to the wall
Any advice what I can or should do, when the wall falls over
I'm guesing someone more knowledgeable than I will be on soon but my guess is that if his property is in a state that he's happy with, and you damage or remove it, you would be liable to replace it or make good the damage.
Well now a third of the wall toppled over into my side whilst they were uprooting a tree as predicted.I offerred to have it carted away but the owner of the wall insisted he retain the debris!! Oh I now discover that this wall was built on on my boundary side by 6"
the remaining part of the wall is left leaning dangerously .
